What is NSA (What is NSA )

This law came into existence on 23 September 1980 during the government of Indira Gandhi. This law gives the central and state governments the right to detain any person who poses a threat to the security of the nation. Under this law, the government and the state government can keep any suspect in jail for 12 months whether he has made any allegations or not.

Every year various cases come in different states and many people are arrested under this law. Recently we have seen that due to attacks on our doctors, nurses and police sweepers, the government of Madhya Pradesh and Uttar Pradesh have enacted this law. Some people were charged and arrested. As I told you what Rasuka is and when it is applied.

In simple language, it means that whenever the Central or State Government feels that any person is creating any problem in the proper functioning of the law and order or is creating any obstruction or causing any kind of harm to the essential servant. If this is happening then the state government or the central government arrests that person.

Provisions of NSA law (Provisions of NSA )

There are many provisions of this law. Friends, let us talk about its provisions –

1 The first provision is that this rule prohibits the Central Government and any State Government from punishing any person for causing harm to the security of India or for causing injury to the relations of India with foreign countries or for disrupting the supply of maintenance of public order by assaulting any policeman on duty. Has the power to arrest for the crime of committing. As an example, arrests have been made in the cases that took place in Madhya Pradesh. Whoever causes harm to our essential servants like doctors, police, sanitation workers, government servants, etc., then he goes straight to jail.

2 The second provision makes us understand that this law gives the power to any concerned officer to keep the suspect in jail without any reason for up to 5 days and if the circumstances are serious then this period can be extended up to 10 days. But it is necessary for that person to take permission from the state government.

3 The third provision is that a person arrested under this law can appeal before any advisory board appointed by the government, but he is not entitled to get the help of any lawyer for the cases against him.

4 Fourth provision, this law has the power to arrest any foreigner or expel him from the country if he causes harm to the activities of any of our country or creates obstruction in the work of essential service.

Imprisonment Under NSA

Friends, now we will know that if any person is arrested under this law, then what is the period of his imprisonment. According to this provision of the National Security Act, the government can keep any suspicious person in jail for 12 months without any charges. If the government finds new evidence against him, this period can also be extended. Whichever state the arrested person belongs to, the concerned authorities of that state cannot arrest that person unless he takes proper evidence and permission.

At most he can keep that person only for 12 days. The example is that Chandrashekhar Ravan, the founder of Bhim Army, was also kept in jail for 1 year after his arrest under this NSA, later he was released. It is important for you to keep in mind that the arrest order should be issued by the Police Commissioner under his respective jurisdiction, if not by the District Magistrate. There are many criticisms of this zodiac sign. Every law has some good parts and some bad parts too, so it is as important to understand it as we understood its provisions and its reasons.

  • If a person does any work in his state which can cause loss to the state, then the state government can get him arrested under NSA.
  • If suppose the state government and the central government are trying to work for the benefit of the country and someone is creating obstacles in doing that work, then the government can arrest them under NSA.
  • If someone creates an obstacle in the law and order of the country, then the government can get him arrested.

Criticisms of NSA

In many cases under the National Crime Records Bureau, arrests under this law are not included because very few FIRs are registered under this law due to which we are not able to get the correct data and also know how many people are arrested every year. Doesn’t work.

Friends, as you know that this is a kind of arrest warrant in which the government can arrest any suspicious person without giving any reason and does not even allow him to have his own lawyer for some time. Compare this law with the British Rowlatt Act. And many experts also say that the government uses NSA as an extra judicial power. Many times this law becomes bad for the people.
